These Terms of Service (“Terms”) govern your use of the Beta version of AfroTech, Inc's ("The Company") mobile application - AfroTok (the “App”). By using the App, you agree to be bound by these Terms.

  1. You may use the Beta version of the App solely for the purpose of testing and providing feedback.
  2. The Beta version of the App is provided “as is” and “as available”, and is not supported.
  3. You should not rely on the Beta version of the App for any purpose.
  4. You understand that the Beta version of the App may contain errors or inaccuracies and may not function properly.
  5. You acknowledge that we may change the features and functionality of the Beta version of the App at any time without notice.
  6. You are solely responsible for any damage or loss that may result from your use of the Beta version of the App.
  7. You agree to comply with all applicable laws in connection with your use of the Beta version of the App.
  8. We reserve the right to terminate or suspend your access to the Beta version of the App at any time for any reason.
  9. You must be at least 18 years of age to use the app.
  10. You agree to the app's privacy policy which can be found by clicking the "priacy" link at the bottom of this page.
  11. You may not use the app for any illegal activities or for any activities that are deemed offensive.
  12. You are solely responsible for any content that you post in the app. You agree not to post, upload, publish, or otherwise make available any User Content that: (a) is unlawful, offensive, obscene, profane, pornographic, threatening, or constitutes hate speech; (b) is intended to harass, stalk, or harm another person; (c) encourages any illegal activities; (d) contains any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or other similar materials; or (e) violates the privacy or publicity rights of any third party.
  13. You agree to not use the app to solicit money or other forms of payment.
  14. You agree to not attempt to damage the app or its functionality in any way.
  15. You agree to not use the app to spam other users or to advertise products or services.
  16. We reserve the right to remove any content that is considered inappropriate or offensive, or that violates any of these Terms of Service.
  17. You agree not to share any confidential information provided in the App or obtained through your use of the App.
  18. You acknowledge that the App is property of the Company and that you will not copy, distribute, or otherwise make use of the App without the Company’s express written consent.
  19. The Company reserves the right to modify or discontinue the App at any time without notice.
  20. You agree to indemnify and hold the Company harmless for any and all damages, losses, or other liabilities caused by your use of the App.
  21. You represent and warrant that you are 18 years of age or older and have the full legal capacity to enter into these Terms.
  22. These Terms constitute the entire agreement between you and the Company and supersede any prior agreements or understandings.
  23. If any of these Terms is found to be unenforceable or invalid, the remaining Terms shall remain in full force and effect.
  24. By uploading content to the App, you represent and warrant that you are the owner of all intellectual property rights in the content and have the right to grant the license granted by these Terms. You retain all of your ownership rights in your content. You also grant us a worldwide, royalty-free, non-exclusive, sublicensable and transferable license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute your content in connection with the Service.
  25. You agree not to reproduce, duplicate, copy, sell, trade, or exploit any content owned by the creator in any way, except as expressly permitted by the creator. You further agree not to use any content owned by the creator in any manner that could be considered an infringement of the creator's copyright or other intellectual property rights. If you are found to be in violation of this clause, you may be subject to legal action.
  26. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws rules.
